Terms of Service
These Terms of Service govern the use of CaseStudies.Chat and each archive operated under it: mistake.club, genius.wiki and change.archi. By creating an account or otherwise using any archive, the user accepts these terms in full.
The operator
CaseStudies.Chat is operated by an individual proprietor established in the People's Republic of China. All correspondence — enquiries, complaints, refund requests, corrections and legal notices — is to be directed to support@casestudies.chat. The operator undertakes to respond within five working days.
The Service
The Service comprises three archives of documented business cases and, on each, an enquiry facility that searches the relevant archive and returns a sourced response. Reading and searching are provided free of charge and without limit. Enquiries are metered; the allowances applicable to free accounts and to Pro subscriptions are set out on the pricing page.
The archives are subject to continuous revision: entries are added, amended and withdrawn. No undertaking is given that any particular entry will remain available, or that the Service will retain its present features. Where a feature relied upon by a paying subscriber is withdrawn, notice will be given in advance and the unused portion of the subscription period refunded on request.
Accounts
- One account reaches every archive. There is no separate mistake.club or genius.wiki account.
- Credentials are the user's responsibility. All activity conducted through an account is attributed to its holder. Where a user believes their credentials have been compromised, notice to support@casestudies.chat will result in all active sessions being terminated.
- Accounts are personal. Sharing credentials, or reselling access to an account, constitutes grounds for termination.
- Minimum age. Sixteen years in the European Economic Area and the United Kingdom, thirteen years elsewhere, or such higher age as the user's own jurisdiction prescribes for entering into a contract of this kind.
Acceptance of these terms
Acceptance of these terms and of the Privacy Notice is required at the point of registration; the sign-up form requires affirmative confirmation and will not complete without it. The date of acceptance and the version accepted are recorded against the account, and a copy of that record is available to the user on request.
A user who does not accept these terms should not create an account. Reading the archives without an account requires no acceptance and is governed only by the provisions of this document concerning use of the content.
Permitted use of entries
Entries may be read, quoted, cited and relied upon in the user's own work and decisions. No further permission is required for such use.
The following are prohibited: bulk downloading, scraping or mirroring of the collection; the compilation of a competing archive from its contents; use of the Service for any unlawful purpose; interference with the Service or with other users; and the harassment of any person or organisation named in an entry. The AI Skill supplied with a Pro subscription is the sole supported means of programmatic access, and its published limits apply.
Users retain ownership of the material they create, including notes and submissions. Submission of an entry grants the operator a licence to publish it, to edit it for accuracy and length, and to retain it in the archive; the user's own rights in that material are unaffected.
Nature of the archives
Entries are summaries of events documented by third parties, published for educational purposes. They do not constitute legal, financial, medical, investment or professional advice, and no advisory relationship arises from their use. The Disclaimer sets out these limitations in full and forms part of these terms.
Complaints and corrections
Each entry page carries a report link, and complaints may also be sent to support@casestudies.chat. A complaint should identify the inaccuracy and cite a source. Complaints are reviewed and entries amended or withdrawn accordingly, ordinarily within five working days and sooner where continued publication would cause harm. Copyright complaints are received at the same address and should identify the work, the page complained of, and the complainant's standing; the material will be withdrawn pending review.
Payment and renewal
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders, which means Paddle is the seller in your payment contract, handles customer-service enquiries about that payment, calculates and remits any tax your country charges, and processes returns. Paddle's own Buyer Terms and Privacy Notice cover the payment itself. We never see or hold your card details.
Pro is an annual subscription which renews automatically. The following particulars are disclosed so that no term of the renewal is unexpected:
- What you are charged: the price set for your market, tax included — $49.90 USD a year where the currency is dollars, ¥348.00 CNY in China, €45.00 EUR across the eurozone, and a price of its own in every other supported currency. The figure you see is the figure that leaves your account; nothing is added at checkout.
- When charged: on the date of purchase, and annually thereafter on the same date, until cancelled.
- How to cancel: from My Subscription, in the same number of steps as the purchase and without contacting anyone, or by written notice to support@casestudies.chat.
- Effect of cancellation: no further charge is made. Access continues until the end of the period already paid for.
- Notice of renewal: notice is sent by email in advance of each renewal, and in every case in advance of a renewal at a revised price.
Prices are subject to change, but no change affects a period already paid for. Refunds are governed by the Refund Policy, which forms part of these terms and which confers a thirty-day right of return in addition to any statutory right.
Termination
A user may close their account at any time by written notice to support@casestudies.chat.
The operator may suspend or terminate an account used to share credentials, to scrape the archive, or to harass any person or organisation named in an entry. Reasons will be given save where the law requires a prior hearing. Where a paid period is curtailed, the unused portion is refunded without application.
Limitation of liability
The archives are provided on an "as is" basis. To the fullest extent permitted by law, CaseStudies.Chat accepts no liability for any decision taken in reliance on an entry or for any consequence thereof, and no liability for indirect or consequential loss, loss of profit or loss of data. Where liability cannot lawfully be excluded, it is limited to the sums paid by the user in the twelve months preceding the claim.
Nothing in these terms excludes or limits liability which may not lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, and any liability which the consumer law of the user's own jurisdiction places beyond the reach of contract.
Consumer rights by jurisdiction
Consumer protection follows the consumer. Where the law of the user's own jurisdiction confers a right which these terms appear to restrict, that right prevails and these terms are construed accordingly. In particular:
- European Economic Area and United Kingdom. You have a statutory right to withdraw from a distance contract within 14 days. Because Pro starts working the moment you buy it, the checkout asks you to agree to immediate performance and to acknowledge that doing so ends that right once the service is fully performed — that is the law's own mechanism, not a waiver we invented. Our 30-day refund is more generous than the statutory 14 days and you may use whichever helps you. Your rights under the GDPR are in the Privacy Notice.
- United States. The auto-renewal terms above are disclosed as California's Automatic Renewal Law and the FTC's negative-option rule require, and cancellation is available in the same place and by the same ease of clicks as the purchase. Residents of California, Virginia, Colorado, Connecticut, Utah and other states with privacy statutes have rights set out in the Privacy Notice — including that we do not sell or share personal information, and never have.
- Canada. Nothing here displaces your rights under provincial consumer protection legislation, and we handle personal information as PIPEDA — and, in Quebec, Law 25 — require.
- Australia and New Zealand. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law and the New Zealand Consumer Guarantees Act. Nothing in these terms excludes, restricts or modifies them.
- Anywhere else. Japan, South Korea, Singapore, Brazil, India and the rest: where your local consumer or data protection law gives you more than this page does, it applies, and writing to support@casestudies.chat is enough to invoke it. You do not have to cite the statute.
Amendment
Amendments to these terms are reflected in the version and date recorded below. Any amendment materially affecting the user is notified by email or published on the site not less than thirty days before it takes effect; the user may cancel before that date and receive a refund of the unused portion of the subscription period. Continued use of the archives thereafter constitutes acceptance.
Governing law and jurisdiction
These terms are governed by the laws of the People's Republic of China. Any dispute not resolved between the parties shall be submitted to the People's Court having jurisdiction at the operator's place of residence. This clause does not derogate from the preceding section: a consumer retains the protection of the mandatory law of their country of residence and may bring proceedings before their local courts where that law so permits.
Users are asked to raise any matter in correspondence before commencing proceedings. Most matters are resolved at that stage.
